- You do not have to be totally unable to work in order to be
eligible to receive Social Security Disability Benefits. You are
allowed to work and earn a certain amount of money and, at the
same time, receive Social Security Disability Benefits. There are,
however, limits on how much you can earn and still be eligible
to receive disability benefits.
- You do not have to wait one full year before you apply for
Social Security Disability Benefits. Although your disabling
injuries or conditions must result in you being disabled for at
least one year, you are allowed to apply for disability benefits
right away.
- You can apply for Social Security Disability Benefits over
the Internet or over the phone and through the mail. The entire
application process can be performed from the comfort and
convenience of your home.
- People who receive Social Security Disability Benefits also
receive full Medicare benefits.
- If you have reached an age where you are entitled to receive
early retirement benefits (usually at age 62), your application
for disability benefits can be processed while you receive monthly
retirement benefits. A monthly disability benefit is greater than
the amount of an early retirement benefit.
- An attorney cannot charge you a fee for representing you in
a claim for Social Security Disability Benefits unless that
attorney is successful in procuring for you disability benefits.
The fee is 25% of the past due benefits only. There is no fee
charged out of your future monthly disability benefits. The fee
is strictly limited to 25% of the past due benefits that
accumulated while your claim was being processed and/or litigated.
- If you are receiving total disability benefits under Florida's
Workers' Compensation Law, you may be entitled to Social Security Disability Benefits
under federal law at the same time.
